Just arbitration for the claret and blue?

Looks like West Ham are going ahead with legal action, which might ultimately lead to the  Court of Arbitration for Sport. Not good to see the law involved, but it's hard to argue with David Gold's comments: "We are hugely disappointed at the outcome of the process.The last thing I want to do is going to some kind of legal issue because I think it is a footballing issue. But we are fighting for our lives. If we were mid-table we would probably get on with it but we are fighting for our lives to retain our Premier League status and we owe it to our fans, we owe it to ourselves. We are upset, we feel we have been badly treated. Most judgements are not made by three people, they are made by 12 - that's why they are called juries."

I agree with the sentiment but can't help thinking we are going to drag the reputation of the club down by pursuing this.

Gold & Sullivan along with Allardici should have managed the transfers better during the summer and in January, then we might not be in such a dire position where the loss of one player seems so threatening.

Can this club get any lower or more embarrassing?.
They have been moaning about Sheffield Utd for years for doing a similar sort of thing.
Andy Carroll swung at the Swansea player with INTENT, he did catch him but not as bad as the player made out but it was still a swing.. He only has himself to blame.
That's bad enough but threatening to take the FA to court is as desperate as it gets..
Take it on the chin like other clubs do and get on with it..
What does this say to the rest of the squad? Without Carroll you lot ain't good enough... PATHETIC..

If you don't think that was with intent then you can't be helped..
Andy Carroll swung round 180% more than he needed knowing he could catch Flores on the head.. That's why the appeal got turned down.. Those who are protecting Carroll are doing so out of desperation..
The board are embarrassing West Ham once again.

Getting relegated is bad enough but this is just ridiculous.
I bet Borriello is delighted he signed for us.. He gets his chance but all everyone is concentrating on is getting Carroll off a red card. We never made this much fuss when Nolan got sent off.
Give the new lad a chance and drop this nonsense.

Who is the "180 degree" half-wit????. Think before you post rubbish. The foul initially was for Carroll as Flores climbed all over his back, Flores elbow catches Carrolls face, and then he continues to purposely hang all over Carroll who did what we'd all do and threw him off, swinging round in the process. Ever heard of momentum and balance you muppet. Trust me, at 6'4" Carroll would have laid the cheating slimeball out if he "caught" him. Get back to knitting you dope.

Andy Carroll is the best striker in the league without him we are doomed. If the FA let him off then we will finish high up the league. I hate Flores he has ruined our season.

I'm not happy we're going down this route. And I don't see how we have a case. If there is any doubt either way then Webb's decision will be upheld.
Having said that, I read today that just by lodging the legal action we get to play AC in the meantime. If that's true then maybe this is an inspired move on Gold's part.
One thing's for sure. There needs to be a move for retrospective banning for simulation. For everyone's sake, not least the refs.

There was NO INTENT to injure Cheato Flores by Andy Carrol, the perceived look of anger on Carrol's face was due to having Flores weighing down upon his back prior to the spin to remove said parasite.

Let's all grow up and DO THE RIGHT THING, Webb is only human and made a mistake (which an honest person would own up to) as Andy is innocent.

Carroll knew what he was doing and rightly got sent off.
Have you ever heard so much fuss from one club though?
Grow a pair and accept the ban like every other club does.
Carroll is so over rated anyway. All he has to his game is the fact that he can head down high hoof balls in the box. Just look at how many goals a season he gets.
You know you're in trouble when Carroll is your best player and it's the end of the world when you lose him for three games..

Seem to have got a lot of wind-up merchants from other clubs here, via Google+ I assume. Carroll is looking at the ref and appealing, not trying to catch Flores. But agree with James Hunt we should never have been so reliant on one striker pin the first place. Should know arbitration result soon…
